In the special edition "Construction and Public Procurement" of our newsletter, we inform you about the interplay between public and private law regarding pipes, cables and conduits, as well as about the revision of the building and zoning regulations and the potential risks this entails for landowners.

Every property is dependent on pipes, cables and conduits for the purpose of infrastructure. Whether it is cables for the supply of energy (e.g. electricity) or pipes for the supply of certain substances (e.g. gas), the mesh of public law and private property law make this a difficult area to navigate. Where the challenges lie and what to look out for as early as the planning stage is discussed in our newsletter.

The Lucerne municipalities have time until 31 December 2023 to adapt their building and zoning regulations (BZR) to the current legal situation and thus to the Intercantonal Agreement on the Harmonisation of Construction Terms (IVHB). Among other things, the change from the "Ausnützungsziffer" to "Überbauungsziffer" must be implemented, which may not always have a positive effect on properties that have already been built over. In our newsletter, we explain why the revision of the communal building and zoning regulations could possibly lead to a restriction of use for owners of already built-up land and what owners need to be aware of.
