Debt Collection & Bankruptcy

We support our clients in all matters relating to collection, debt enforcement, dismissal of objections to collection, bankruptcy, attachment, fraudulent preference proceedings, etc.

Debt Collection & Bankruptcy
  • Advice and support in debt collection matters

Our debt enforcement and bankruptcy attorneys will assist you both with debt collection and with determining the strategy required to obtain payment. We carry out solvency checks, support you in extrajudicial collection matters, debt enforcement, actions for payment, applications to dismiss objections and bankruptcy proceedings. Should it be necessary to secure claims, we will examine the option of attaching (placing a lien on; securing assets) your debtor's assets.

  • Obtaining deletion of unjustified entries on the debt enforcement register

Unjustified debt enforcement proceedings can be a great annoyance for those affected. Our attorneys specialising in debt enforcement and bankruptcy law will analyse debt enforcement proceedings initiated against you and work with you to identify the options for defending against them. Where debt enforcement entries are unjustified, we assist you in having them deleted from the debt enforcement register.

  • Defending against claims

Our debt enforcement and bankruptcy attorneys will provide you with legal support in defending against claims. We will support you in negotiations with creditors. If necessary, we will represent you in related court proceedings (e.g. debt enforcement, actions for dismissal of objections to collection, bankruptcy and attachment proceedings or actions for payment).

  • Trustee appointments in bankruptcy

Our law firm accepts bankruptcy trustee appointments and carries them out reliably and competently. This work includes, in particular, implementing judicial composition agreements or emergency moratoria as well as managing companies with organisational defects. Our attorneys at law Christian Leupi, Michael Schumacher and Andreas Galli hold the office of trustee in bankruptcy for Lucerne.

  • Extrajudicial and in court representation

Our law firm will provide you with support in all matters of debt enforcement and bankruptcy law, both in extrajudicial proceedings and in proceedings before conciliation authorities, ordinary courts, commercial courts or arbitral tribunals in Lucerne and throughout Switzerland, which naturally also includes communicating on your behalf with debt enforcement and bankruptcy authorities.
